Interpretation of Technical Management Regulations for Road Transport Vehicles

 

 

Recently, the Ministry of Transport announced the newly revised "Regulations on the Technical Management of Road Transport Vehicles" (Ministry of Transport Order No. 3 in 2023, hereinafter referred to as the "Regulations"), which will take effect from June 1, 2023。In order to facilitate the relevant units and the public to better understand the implementation, and effectively do a good job in the implementation of the Provisions, it is interpreted as follows:


First, the need for revision

To strengthen the technical management of road transport vehicles,Improve vehicle safety and energy efficiency,The Ministry of Transport issued the Regulations in 2016.,It was partially revised twice in 2019 and 2022,It has played an important role in regulating the technical management of road transport vehicles and promoting the healthy development of the industry。However, with the implementation of "three inspections in one" for road freight vehicle safety technical inspection, comprehensive performance testing and emission testing, the inspection and testing institutions, technical standards, cycle frequency, etc., have been unified, and the relevant requirements related to inspection and testing in the "Provisions" need to be adjusted accordingly。At the same time, the safety management system such as road transport vehicle compliance management implemented by the Ministry of Transport in recent years and the measures such as off-site inspection of general cargo vehicles and online annual review for the benefit of enterprises and people also need to be upgraded to regulations to be solidified。There is therefore an urgent need for a comprehensive revision of the Provisions。

Second, revise the main content

The revised Provisions have a total of 6 chapters and 34 articles, the main amendments include:

(1) Fully implementing the reform requirements of the "three inspections and integration"。First, the relevant statements and requirements involving comprehensive performance testing institutions have been modified, and it is clear that road transport operators will conduct inspection and testing by inspection and testing institutions that have obtained the qualification of the market regulatory authorities。Second, mutual recognition of inspection results and data sharing should be implemented,Motor vehicle inspection and testing institutions are required to carry out inspection and testing in accordance with the "Motor Vehicle Safety Technical Inspection Items and Methods" (GB38900),Issue a unified inspection report,And timely, accurate and complete upload inspection data and reports,Realize the detection data and report network sharing。Third, according to the requirements of the reform, the inspection and testing cycle and frequency of freight vehicles are unified to 1 test per year within 10 years and 1 test every six months after 10 years。

(2) Strengthen supervision over the safety performance of road transport vehicles。First, strictly control the entrance of road transport vehicles, clarify the responsibility of the management department for real vehicle verification, and carry out real vehicle verification on the safety and energy-saving related parameter configuration of vehicles applying to enter the road transport market and the type rating information of buses, to ensure that vehicles meet the safety and other related standards。The second is to clarify the exit requirements of road transport vehicles, and for road transport vehicles that meet the mandatory scrapping standards, the road transport certificate should be cancelled to effectively protect the safety performance of the vehicle。

(3) Improve the technical management service level of road transport vehicles。First, the implementation of off-site inspection and testing of general vehicles, general vehicles can independently choose motor vehicle inspection and testing institutions throughout the country。The second is to optimize the technical rating system, and clearly require motor vehicle inspection and testing institutions to directly note the technical grade of vehicles when issuing inspection and testing reports。Third, it is clear that if road transport vehicles obtain online annual inspection certificates, they can be exempted from marking the technical grade of vehicles on the road transport certificate, and reduce the burden of marking procedures for their round-trip vehicle registration and transport residence。
